These Terms of Service ("Terms") govern your access to and use of the Florida Business Leads platform at floridabusinessleads.com ("FBL," "we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Description of Service

FBL is a business lead discovery platform that provides information about new business openings in Florida. Users browse available leads, then spend credits to unlock full contact details. The platform also includes CRM-lite features such as notes, tags, pipeline management, and CSV export, depending on your subscription tier.

2. Accounts

To use FBL, you must create an account. You must be at least 18 years old and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3. Subscriptions and Billing

FBL offers a free tier and several paid subscription plans billed monthly through Stripe. Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time from your account settings. Upon cancellation, you retain access to your current plan's features through the end of your billing period, after which your account reverts to the free tier.

We reserve the right to change pricing with at least 30 days' notice. Price changes apply at the start of your next billing cycle following the notice period.

4. Credits

Credits are used to unlock lead contact information. Each subscription tier includes a monthly credit allotment. Credits may also be purchased separately in one-time packs. Credits have no cash value and are non-transferable. Monthly credits that are unused may roll over according to your tier's rollover policy; otherwise, they expire at the end of the billing period. Purchased credit packs do not expire.

5. Acceptable Use

You agree not to:

• Use automated tools, bots, or scrapers to access or collect data from the platform
• Resell, redistribute, or sublicense lead data obtained through FBL
• Use the platform or lead data to harass, spam, or send unsolicited bulk communications
• Attempt to circumvent the credit system, access controls, or security measures
• Use the platform for any unlawful purpose or in violation of applicable regulations
• Share account credentials or allow multiple individuals to use a single-user account

6. Data Accuracy

Lead information is provided on an "as is" basis. While we make reasonable efforts to ensure accuracy and timeliness, we do not guarantee that any lead's contact information, business status, or other details are current, correct, or complete. Business information changes frequently, and some data may be outdated by the time you access it. FBL is not liable for decisions you make based on lead data.

7. Intellectual Property

The FBL platform, including its design, software, logos, and compiled datasets, is the property of FBL and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the platform for your internal business purposes. You retain ownership of any notes, tags, or other content you create within the platform.

8. Limitation of Liability

To the maximum extent permitted by law, FBL and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including lost profits, lost data, or business interruption. Our total liability for any claim arising from these Terms or the platform shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

10. Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms or engaged in conduct that is harmful to the platform or other users. Upon termination for cause, you forfeit any remaining credits and access to the platform. You may also close your account at any time by contacting us.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the platform. Your continued use of FBL after such changes constitutes acceptance of the updated Terms.
